Ethics Hearing on Alleged Immorality of KPU Chairman Held Closed, DKPP Council Promises to Be Objective

According to him, the DKPP prioritizes the reported complaints by scheduling a quicker hearing. If waiting for the 90 pending reports to be heard, the next session can only be held around three to four months from now. His team is targeting the hearing to be no later than the end of May.

"We prioritize handling this case because it has captured public attention. Also, to provide legal certainty for the complainant and the defendant," said Heddy during a press conference in Jakarta on Wednesday (May 8, 2024).

Previously, on Thursday (18/4/2024), a member of PPLN Den Haag reported Hasyim to the DKPP on allegations of violating the code of ethics for election organizers. The report was submitted by a legal representative from the Legal Aid Consultation Agency of the Faculty of Law at the University of Indonesia.

In its report, Hasyim's actions deemed to violate the election commission's code of ethics occurred from August 2023 until March 2024. The incidents took place in several cities in Indonesia and abroad.

As for the actions allegedly committed by Hasyim, they include actions that violate the integrity of the election organizers based on the principles of honesty and fairness. This is because Hasyim's actions prioritize personal interests and give special treatment to members of the PPLN compared to other members of the PPLN.

Hasyim is also suspected of taking actions that violate the professionalism of election organizers based on the principle of proportionality. This is because Hasyim's attitude and actions did not announce the existence of personal relationships or connections that could lead to conflicts of interest in carrying out the duties of election organizers. In this case, Hasyim promised to marry a member of the PPLN.

Furthermore, continued Heddy, the trial for alleged ethical violations will be held behind closed doors. Because according to procedural law at DKPP, alleged violations of the code of ethics in the form of immoral acts must be carried out behind closed doors. Moreover, the complainant also requested that the trial be held behind closed doors.

Nevertheless, the DKPP assembly that is examining the alleged ethical violations report will take an objective stance. DKPP will not discriminate against the background of the accused even if the accused is a top leader of the election organizer at the central level and often interacts in various stages of the election organizing process.

Heddy asserts that DKPP decisions are always based on the facts presented during the trial. There are no other considerations except those revealed during the trial. Therefore, the sanctions given to the accused are always in accordance with the factual basis of the trial, without extending to other matters outside the substance of the trial.

"The level of sanctions, the level of punishment we give to election organizers is in accordance with the facts found in the core of the case being tried," he said.

Separately, the lawyer for the plaintiff, Maria Dianita Prosperianti, hopes that the DKPP will prioritize the handling of the reported breaches of ethical codes filed by her client. She and her client have been waiting for a long time and hope that the case will be tried soon.
